Substance Abuse and Mental Health in the Workplace: A Problem of Epidemic Proportion

Now more ever, employers encounter issues with employees who suffer from alcoholism, drug abuse and mental health issues. Whether such issues cause performance issues, prompt leave requests or necessitate separation, the laws related to these issues are both varied and complex. This session will navigate an employer’s legal obligations under the Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), state drug testing statutes and other relevant laws.
- Understand an employer’s basic legal obligations when employees report substance abuse or mental health issues.
- Identify whether the underlying condition is protected under relevant federal or state law.
- Apply FMLA requirements appropriately when required.
- Determine whether a reasonable accommodation is necessary under ADA to enable the person to perform essential functions of the position.

Sara McCue is an attorney at Baird Holm LLP where her practice focuses on employment, ADA, and fair housing law. McCue represents and counsels housing providers, property management companies, educational institutions and the affordable housing industry. McCue received her juris doctor from the University of Nebraska College of Law where she was the editor in chief of the Nebraska Law Review and president of the Multicultural Legal Society and Black Law Students Association. Prior to that, she graduated from the University of Nebraska-Lincoln with a bachelor’s degree in journalism.
Scott Moore is a partner at Baird Holm LLP where he practices in the areas of management-side employment law.
